1. Agreement to Terms
By accessing our website happytrailstravel.in and booking our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our services.
These terms constitute a legally binding agreement between you ("Customer," "you," or "your") and HappyTrails ("we," "our," or "us").
2. Services Provided
HappyTrails acts as an agent and intermediary for:
- Airlines, hotels, and transportation providers
- Tour operators and local guides
- Travel insurance providers
- Visa processing services
- Other travel-related service providers
Important: We arrange travel services but do not operate airlines, hotels, or tour activities directly. We are not liable for the acts, errors, omissions, or defaults of these third-party providers.
3. Booking Process
3.1 Quotations
- Quotations are valid for 48 hours unless stated otherwise
- Prices are subject to availability at the time of booking
- Prices may change due to currency fluctuations, fuel surcharges, or supplier price increases
- All prices are in Indian Rupees (INR) unless specified otherwise
3.2 Booking Confirmation
Bookings are confirmed only after:
- Receipt of required deposit or full payment
- Confirmation from suppliers (airlines, hotels, etc.)
- Issuance of booking voucher or confirmation email
A booking is not confirmed until you receive written confirmation from us.
3.3 Payment Terms
Domestic Packages:
- 50% deposit at time of booking
- Balance payment 15 days before travel date
International Packages:
- 50% deposit at time of booking
- Balance payment 30 days before travel date
Peak Season (December 20 - January 10):
- Full payment may be required at time of booking
- Specific terms will be mentioned in booking confirmation
4. Pricing and Inclusions
4.1 Package Prices Include
- Flights (economy class unless specified)
- Hotel accommodation as per itinerary
- Meals as mentioned in package details
- Transfers and sightseeing as specified
- Services of tour guide (where applicable)
4.2 Package Prices DO NOT Include
- Visa fees and passport costs
- Travel insurance (highly recommended)
- Personal expenses (laundry, telephone, minibar, etc.)
- Tips and gratuities
- Meals not mentioned in itinerary
- Optional activities and excursions
- Any services not explicitly listed in package details
- GST and other applicable taxes (unless specified)
5. Travel Documents
5.1 Customer Responsibility
Customers are solely responsible for:
- Valid passport (minimum 6 months validity from return date)
- Necessary visas and entry permits
- COVID-19 vaccination certificates (if required)
- Health certificates and medical clearances
- Travel insurance documentation
5.2 Agency Support
We provide:
- Guidance on visa requirements and application process
- Assistance with visa documentation
- Information on entry requirements
Important: We do not guarantee visa approval. Visa rejection does not entitle you to a full refund. See our Cancellation Policy for details.
6. Changes and Modifications
6.1 Changes by Customer
- All change requests must be made in writing
- Changes are subject to availability
- Amendment fee: ₹2,500 per person plus supplier charges
- Name changes, date changes, and route changes may incur additional costs
- Changes within 15 days of travel may not be possible
6.2 Changes by Suppliers
Airlines, hotels, and tour operators may change:
- Flight schedules and routes
- Hotel accommodations (to similar category)
- Tour itineraries
We will notify you of significant changes and offer alternatives where possible. We are not liable for minor changes or delays.
7. Force Majeure
We are not liable for failure to perform our obligations due to circumstances beyond our control, including but not limited to:
- Natural disasters (earthquakes, floods, hurricanes)
- Pandemics, epidemics, or health emergencies
- War, terrorism, or civil unrest
- Government restrictions or travel advisories
- Airline strikes or technical failures
- Acts of God
In such cases, standard cancellation charges apply unless otherwise covered by travel insurance.
8. Liability Limitations
8.1 Our Liability is Limited To
- The total value of services booked
- Direct damages only (no consequential or indirect damages)
- Subject to supplier liability limits
8.2 We Are NOT Liable For
- Acts, errors, or omissions of third-party suppliers
- Lost, stolen, or damaged luggage
- Personal injury, illness, or death (covered by supplier/insurance)
- Missed connections due to delays
- Failure to obtain necessary travel documents
- Consequences of your failure to follow instructions
- Force majeure events
9. Travel Insurance
Highly Recommended: We strongly advise purchasing comprehensive travel insurance covering:
- Trip cancellation and interruption
- Medical emergencies and evacuation
- Lost, stolen, or delayed baggage
- Personal liability
- COVID-19 related coverage
Travel insurance is your responsibility. We can recommend insurance providers but do not sell insurance directly.
10. Customer Conduct
Customers must:
- Comply with all local laws, customs, and regulations
- Follow instructions of tour guides and hotel staff
- Respect other travelers and local communities
- Behave in a manner that does not endanger themselves or others
- Not engage in illegal activities
Consequences: We reserve the right to terminate services immediately for disruptive, illegal, or dangerous behavior without refund. You will be responsible for all costs incurred due to such termination.
11. Health and Safety
- Customers must disclose any medical conditions that may affect travel
- Customers are responsible for obtaining necessary vaccinations
- We recommend consulting a doctor before international travel
- Customers must follow safety instructions provided by guides and operators
- Adventure activities are undertaken at customer's own risk
12. Complaints and Disputes
12.1 Complaint Procedure
- Report issues to our representative immediately during travel
- Submit written complaints within 7 days of return
- Include booking reference, dates, and detailed description
- Provide supporting evidence (photos, receipts, etc.)
12.2 Resolution Process
- We aim to acknowledge complaints within 48 hours
- We aim to resolve complaints within 14 days
- If unresolved, disputes may be escalated to mediation
13. Data Protection and Privacy
Your personal information is processed in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023. By using our services, you consent to such processing.
14. Intellectual Property
- All content on our website is protected by copyright
- You may not reproduce, distribute, or modify our content without permission
- Our logo, brand name, and trademarks are our property
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and Cancellation Policy, constitute the entire agreement between you and HappyTrails regarding the use of our services.
17. Amendments
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of modified terms.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of courts in India.
